Whitestown Police Major James R. Fouch Jr. was acquitted of official misconduct but found guilty of deception by a six-person jury Wednesday afternoon, July 25.
The six-person jury received the case after 11 a.m. Wednesday and deliberated for about five hours. Fouch was accused of deceiving Abbott Laboratories into giving up the Jeep by claiming it had been used in the commission of a crime, about the vehicle’s condition, and about the cost of storage and other fees the company would bear if it wanted the 2007 Laredo returned.
Fouch will be sentenced on the class A misdemeanor deception charge at 1 p.m. Friday, Aug. 24. Until then, the verdict is unofficial, Superior Court I Matthew Kincaid said. The judge dismissed a theft charge earlier this week.
Fouch could be sentenced to up to a year in jail and $5,000 in fines, but Kincaid can choose anything within those ranges.
“I don’t like it, but I have to accept it,” Fouch said, as friends, family and members of the Whitestown Police Department gathered around him at the back of the Superior Court I courtroom.
