Whitestown, Zionsville reach compromise

Zionsville — Whitestown and Zionsville have come together to find a happy medium over Worth Township territory each planned to annex.

The Whitestown Town Council adopted an interlocal cooperation agreement with Zionsville during its meeting Tuesday night, Feb. 12. The Zionsville Town Council still must adopt its version of the agreement.

The two towns were in a battle after both introducing ordinances annexing a similar area of Worth Township, which is west of County Road 775 East, north of County Road 500 South, east of County Road 650 East and south of County Road 200 South.

“We thought it would be in the best interest to see if there was a way to work out the annexation that would be best for all parties,” said Steve Unger, an attorney with Bose, McKinney and Evans who represents Whitestown. “We went through a lot of negotiations, and we feel this is the best possible solution.”

Zionsville Town Council president Jeff Papa called the agreement a win-win.

“I think it’s a good solution to the problem we had,” he said. “I think that both sides should be happy. Whitestown got a lot of things they were after; we have the two towns not fighting over it.”

The agreement excludes a handful of parcels from Whitestown’s annexation and allows Zionsville to annex the remaining portion of eastern Worth Township. The parcels are homeowners that expressed an interest in being annexed by Zionsville.

Also part of the agreement is to allow Boone Meadow Elementary and the adjoining property owned by Zionsville Community Schools to be transferred to Zionsville, and for the owners of the PK property, which is on the south side of Whitestown Parkway between Lowe’s and the Maple Grove subdivision, to decide if they wish to remain in Whitestown or be transferred to Zionsville.

“The developer that owns that has until Oct. 1 to decide if they want to be excluded from Whitestown and be part of Zionsville,” Unger said. “If they do transfer, Zionsville would pay for half of the stoplight (at Whitestown Parkway and County Road 700 S.) or up to $100,000.”
